FUNDAMENTAL RIGHTS:
TITLE
VOILATINS AND THEIR EFFECTS AND IMPACT ON SOCIETY
ABSTRUCT:
Fundamental rights are essential human rights that are offered to every citizen irrespective of caste, creed, religion or gender etc. These are equal to freedoms and these rights are essential for personal good and the society at large. The constitution of Pakistan contains articles about fundamental rights. Articles 8 t 28 covers all the rights which are provides to every citizen of Pakistan. No person shall be deprived of life or liberty, save in accordance with law as well as ALL Pakistani citizens have equal rights. But in the society violation of human rights is common nowadays due to this people become depressed and insurgence towards the state. Government has power to protect their rights and save in accordance with law.so that every individual live their life peacefully.

INTRDUCTION:
Rights means those freedom which are essential for personal good of the community so the Fundamental rights are essential human rights that are offered to every citizen irrespective of caste, creed, religion or gender etc. These are equal to freedoms and these rights are essential for personal good and the society at large. Some universal recognized rights that have seen fundamental rights like right to religious. Right to peace full assembly, right to freedom of association, right to freedom of thought ,right to freedom of movement, right to liberty etc. All of them are important for every citizen which live to anywhere in the society. These rights are regarded as fundamental because they are most essential for the attainment by the individual of his full intellectual, moral and spiritual status. It is important for the society because people are being treated fair everyone works together, love problem easily, cares for other feel safe and get along. It should be important to a person to act with fairness. Government has power to protect their rights and save in accordance with law.

HISTORICAL BACKGROUND:
FUNDAMENTAL RIGHTS STATE IN CONSTITUTIN OF PAKISTAN:
Constitution’: Constitution is a set of fundamental principles or established precedents. In other words according to which a state or other organization is governed.

The constitution of Islamic republic of Pakistan:
Fundamental rights are those basic conditions of social life without which a citizen be at his been self or those basic condition which are very essential for the goof life of a citizen. Fundamental rights are enshrined in the constitution f Islamic republic of Pakistan. The constitution of Pakistan contains articles about fundamental rights. Articles 8 t 28 covers all the rights which are provides to every citizen of Pakistan but there we discuss some fundamental rights guaranteed to every individual person of Pakistan.

1: Security of person: No person shall be deprived of life or liberty, save in accordance with law (article9).

2: Safeguard against discrimination in services: No citizen otherwise qualified for appointment in service f Pakistan shall be discriminated against in respect of any such appointment on the ground only of race, religion, caste, sex etc.(article 27)
3: Equality before law: ALL Pakistani citizens have equal rights and have to obey the same laws irrespective of their caste, religion, wealth or sex. There shall be no discrimination on the basis of sex.(article25)
4: Prohibition for slavery and forced labor: Slavery is forbidden and no law shall permit of facilitate its introduction into Pakistan in any form. (article11)
5: Freedom of speech: Every citizen shall have the right to freedom of speech and expression and there shall be freedom of the press subject to any reasonable restriction imposed by law in the interest of Islam or the integrity, security or defense of Pakistan or any part thereof, friendly relations with foreign states, public order, or in relation contempt of court or incitement to an offence.(article19)
VOILATION IN PAST 10 YEARS:
Martial law:
On October 07, 1958, president Iskandar mirza imposed martial law in the country and abrogated the constitution then president ayub khan abrogated the constitution as well as zulfikar ali bhutto and zia ul haq imposed martial law in their period .The martial law against the constitution because it damaging for the country due to this we are still facing threats of terrorism, extremism, and unstable democratic system.

Human right:
Human right violations during 2015 across Pakistan, there have been 3116 murder cases, in which723 were of abduction and target killing,307 torture,413 of sexual and gang assault,262 cases of honor killing/karakori,90 acid attacks,58 missing persons,16 sexual harassment cases and 14 killing in police custody, while 1570 others were reported during this time span.

Women right:
The council of Islamic ideology (CII) proposed its version of a women protection bill which is against the article 25 of the constitution because proposed draft allow the “light” beating of women by their husband .It also prohibits women from working in a mix gender environment and so on ,if it enacted anywhere, it would create negative impact on the society .

Freedom right:
Every citizen have right to move freely according to article 15 but for those wanting to participate in long march like scores of lawyers were arrested while leaving Karachi which is against the constitution of Pakistan.

Right to assemble peacefully:
Citizens are prevented from assembling. British imperial power enacted in 1898,a device to keep the natives from becoming restless after more than a century, government continue to take recourse to this instrument which violate the article 16 of the constitution.

Association right:
Every citizen have right to from association article17 which is being denied when the lawyers formed association (the lawyers movement) with civil society ,is anathema to the present dispensation. Rehmen malik warns of terrorist attacks during long march (march13).

Freedom of speech:
Bann the private channels like Geo which is against the (article 19 the freedom of speech and expression and there shall be freedom of the press also.)

Religious freedom:
Blasphemy law is being used as a lethal weapon to kill minorities more than 50000 citizens were killed by religious extremists and fundamentalists in the aftermath of 9/11 in Baluchistan which is against the article 20.Mumtaz Qadari killed salman taseer because he disagreed with taseers opposition to blasphemy law.

IMPACT ON SOCIETY:
1: People will be having and insurgence towards the state.

2: People will be dramatically anti judiciary and law and order institution.

3: People would become insurgents and terrorism and crime rate would increase.

4: Education system would be devasted.

CONCLUSION: The fundamental rights is important for the protection of the interests of the minorities, foundation of rule of law etc. According to the state of constitution of Pakistan fundamental rights are those basic condition which are essential for the good life of a citizen due to their importance so many articles being the part of the constitution of pakistan but in the society violation is practice and due to violation terrorism and crime rate would increase. People will be dramatically anti judiciary and law and order institution.According to the situation this matter will be resolve if Justice system in the society because justice is the core of the problem; justice should not only to be done but seems to be done for the establishment of welfare and peaceful state. Securing fundamental rights and promotion of social justice leads the state toward good governance where peaceful society is to be achieved.
